1. Product Disclosure

The product used by Malaz Ink Studio is a professional dye-based body art product and is not derived from the natural henna plant (Lawsonia inermis). It produces a bold, dark, tattoo-like finish. This product contains synthetic colorants and chemical compounds that differ substantially from traditional natural henna.

By proceeding with this service, the Client acknowledges they have been clearly informed of this distinction and understand the nature of the product being applied to their skin.

2. Assumption of Risk & Informed Consent

The Client understands and voluntarily accepts that:

  • Dye-based body art products may cause skin irritation, allergic contact dermatitis, redness, itching, swelling, blistering, or other adverse skin responses in certain individuals, particularly those with sensitive skin, known chemical or dye allergies, or a history of skin reactions.
  • Reactions may range from mild to severe, potentially requiring medical attention.
  • A patch test is available upon prior request and is strongly recommended for clients with sensitive skin or any known dye allergy. By not requesting a patch test, the Client assumes all associated risks.
  • Results vary based on individual skin type, skin condition, body temperature, and placement location. Malaz Ink Studio makes no guarantee of color uniformity, duration, or specific outcome.
  • The dye-based product may stain clothing, fabric, or surfaces. The Client assumes responsibility for protecting their clothing and belongings during and after the service.
3. Client Health Disclosure Requirement

The Client certifies that they have disclosed to Malaz Ink Studio, to the best of their knowledge, any and all known skin conditions, allergies, sensitivities, medical conditions, medications affecting skin integrity, or prior adverse reactions to dyes, cosmetics, or chemical products — including but not limited to: eczema, psoriasis, rosacea, active skin infections or open wounds, keloid scarring, para-phenylenediamine (PPD) allergy, or other chemical sensitivities.

Malaz Ink Studio reserves the right to decline service to any client whose disclosed condition poses, in the artist's reasonable judgment, a health or safety risk to that client.

4. Release of Liability & Waiver of Claims

In consideration of receiving services from Malaz Ink Studio, the Client, on behalf of themselves and their heirs, legal representatives, and assigns, hereby releases, waives, and forever discharges Malaz Ink Studio, its owner(s), artists, contractors, agents, and representatives from any and all claims, demands, causes of action, damages, losses, costs, and expenses — including medical and legal expenses — arising out of or relating to:

  • Skin irritation, allergic reaction, or any adverse skin response to the dye-based product used in this service;
  • Any pre-existing skin condition, allergy, or sensitivity not disclosed prior to the appointment;
  • Individual skin variation affecting color intensity, fading, longevity, or design outcome;
  • Staining of clothing, personal property, or surfaces;
  • Aftercare decisions made by the Client following the service appointment.

This release applies to claims arising from ordinary negligence. It does not release Malaz Ink Studio from liability for gross negligence, willful misconduct, or intentional harm.

5. Aftercare Responsibility

The Client acknowledges that they will receive aftercare instructions and agrees to follow them. Malaz Ink Studio is not responsible for outcomes resulting from failure to follow aftercare guidance, including premature fading, smearing, or adverse skin reactions caused by improper care.

If the Client experiences any unusual or severe skin reaction following the appointment, they agree to seek prompt medical attention and notify Malaz Ink Studio at MalazInkStudio@gmail.com as soon as practicable.

6. Photography & Marketing Consent

Malaz Ink Studio may photograph completed designs for promotional use on social media, the studio website, and other marketing materials. No personally identifying facial images will be used without separate written consent. The Client may opt out of photography by notifying the artist at or before the time of service. Opting out will not affect service delivery.

7. Deposit, Cancellation & No-Show Policy

The Client confirms they have reviewed and agree to the following terms:

  • A non-refundable 30% deposit is required to secure any appointment. The deposit is applied toward the session total.
  • Cancellations must be made at least 24 hours in advance. One reschedule is permitted with at least 24 hours' notice.
  • Last-minute cancellations (within 24 hours) require payment of 40% of the remaining session balance within 24 hours of cancellation.
  • No-shows without prior notice result in an automatic booking ban and forfeiture of the deposit. The full session balance must be paid before future bookings will be accepted.
  • Late arrivals: A 10-minute grace period is provided. Arriving 10–20 minutes late may shorten the design. Arriving more than 20 minutes late may result in appointment cancellation with no refund of deposit.
8. After-Hours & Travel Fees

Appointments after 11:00 PM require prior approval and incur a $10 after-hours fee, payable in full in advance. Travel service outside the primary service areas (Lowell and Attleboro, MA) incurs a fee of $15 base + $1.50 per mile beyond 5 miles from UMass Lowell, confirmed before booking.

9. Governing Law & Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. The parties agree that any dispute arising under or related to this agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts. In the event of a dispute, the parties agree to attempt good-faith resolution before initiating formal legal proceedings.

10. Entire Agreement & Severability

This document constitutes the entire agreement between the Client and Malaz Ink Studio with respect to the subject matter herein and supersedes all prior discussions, representations, or agreements. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Electronic Signature

The Client agrees that typing their full legal name in the signature field below constitutes a valid and legally binding electronic signature in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable Massachusetts law, with the same legal effect as a handwritten signature.

Step 5 — Deposit Payment

How your deposit works

A 30% non-refundable deposit is required to confirm your appointment. After submitting this form, you will send the deposit to Malaz Ink Studio via your selected payment method below. Your appointment is held but not confirmed until the deposit is received. A confirmation email from MalazInkStudio@gmail.com will be sent once payment is verified.
